1. Agreement to Terms
These Terms of Service ("Terms") apply to your use of winwynnrealty.com, our property and landing pages, our online forms, and our phone, text message (SMS) and email communications (together, our "Services"). Win Wynn Realty ("Win Wynn Realty," "we," "us" or "our") is a real estate business operated by Michael Wynn, a licensed California real estate agent (DRE #01496810) affiliated with Century 21 Affiliated. By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
2. Our Services
We help people buy and sell homes in North San Diego County and surrounding areas. Our Services include:
- Property information, home searches and home valuations
- Appointment and showing scheduling
- Buyer and seller representation and transaction coordination
-Market updates and other real estate information
We use a customer relationship management (CRM) platform, GoHighLevel, to manage client information and send some communications automatically, such as appointment confirmations. A formal agency relationship with us is created only by a signed written agreement, not by using our website or submitting a form.
3. Communications and Consent
When you submit a form or contact us, you agree that we may respond to you by email or phone about your request. We send text messages only to people who opt in by checking a consent box on one of our forms. Consent to receive text messages is not a condition of any purchase or service.
You can opt out of emails by clicking "unsubscribe" in any marketing email, and out of calls by asking us to stop calling you.
4. SMS Messaging Terms

Types of messages. We offer two separate types of text messages. You can opt in to either, both or neither:
- Non-marketing messages: appointment confirmations and reminders, responses to your inquiries, information you request about specific properties, and updates about your real estate transaction
- Marketing messages: new listings, market updates, open house invitations and home value updates
Message frequency. Message frequency varies based on your activity with us, for example during an active home search or transaction.
Message and data rates. Message and data rates may apply. Contact your wireless provider with questions about your text or data plan.
Opting out. Reply STOP to any message, or text STOP to (760) 576-2601, at any time. You will receive one message confirming you are unsubscribed, and no further texts unless you opt in again.
Help. Reply HELP to any message, or email [email protected] or call (760) 576-2601.
Carrier disclaimer. Carriers are not liable for delayed or undelivered messages.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.
5. Your Responsibilities
You agree to provide accurate information, keep your contact information up to date, and use our Services only for lawful purposes. You agree not to:
- Use our Services for fraudulent or unlawful activity
- Attempt to gain unauthorized access to our systems or data
- Submit someone else's information without their permission
- Transmit harmful or malicious content, or interfere with our Services
6. Property Information
Listing and property information on our website comes from the Multiple Listing Service (MLS), public records and other third parties. It is believed reliable but is not guaranteed, may change without notice, and should be independently verified. Properties may no longer be available.
7. No Legal, Tax or Financial Advice
Information we provide is general real estate information. It is not legal, tax, lending or financial advice. Please consult the appropriate professional before making those decisions.
8. Fees and Commissions
Any fees or commissions for our real estate services are set out only in a separate written agreement signed by you.
9. Intellectual Property
All content on our website, including text, photos, graphics and logos, belongs to Win Wynn Realty or its licensors and may not be copied or used without our written permission. Century 21 marks belong to their owner and are used under license.
10. Disclaimers
Our website and Services are provided "as is" and "as available." We do not guarantee that the website will be error-free or uninterrupted, or any particular market outcome, sale price or availability of any property.
11. Limitation of Liability
To the fullest extent permitted by law, Win Wynn Realty is not liable for any indirect, incidental, special or consequential damages arising from your use of our website or Services. Nothing in these Terms limits obligations we owe you under a signed representation agreement or under California law.
12. Indemnification
You agree to indemnify and hold harmless Win Wynn Realty from claims, damages and expenses arising from your misuse of our Services or violation of these Terms.
13. Termination
We may suspend or end your access to our website or Services if you violate these Terms or applicable law.
14. Governing Law
These Terms are governed by the laws of the State of California.
15. Changes to These Terms
We may update these Terms from time to time. The "last updated" date at the top shows when they were last changed. Continued use of our Services after a change means you accept the updated Terms.
